dude this tab is sweet - u dont need a capo - its not any harder to Bb minor without one!!
Sure...you can play a Bbm but you loose all the different voicing of the chords. If you like standard bar chords, do it, but it sounds empty and bland.
did you listen to the song? this doesnt sound like it at all try again my friend. Go to mxtabs.net and look at the ones on there. they are so much close than this

I agree with Ken. All the people who think this tab is wrong should post the right one and stop blasting it. With or without the capo it still sounds good.
